1. Acceptance of Terms

By accessing and using AI Arena (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

AI Arena is a platform that allows users to:

• Upload AI-generated images and videos for competitive rating
• Vote on content submitted by other users
• Participate in monthly competitions and view leaderboards
• Track their ELO ratings and statistics

3. User Accounts and Registration

3.1 Account Creation

To use certain features of AI Arena, you must register for an account using Google OAuth. You must be at least 13 years old to create an account.

3.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Ensuring your account information is accurate and up-to-date
• Notifying us immediately of any unauthorized use

4. Content Guidelines and Prohibited Content

4.1 Acceptable Content

You may upload AI-generated content that is:

• Created using AI generation tools (Midjourney, Stable Diffusion, etc.)
• Original or properly attributed
• Appropriate for a general audience
• In supported formats (JPG, PNG, WebP, MP4 under 15 seconds)

4.2 Prohibited Content

5. Content Upload Limits and Restrictions

• Upload Limit: 3 uploads per user per 12-hour period
• File Size: Maximum 50MB per file
• Video Length: Maximum 15 seconds for video content
• Categories: Content must be assigned to one of our predefined categories

6. Voting and Fair Play

6.1 Voting Rules

• Each user may vote on a content pair only once
• Manipulation of votes through fake accounts is prohibited
• Coordinated voting schemes are not allowed

6.2 ELO Rating System

Our ELO rating system is designed to provide fair competition. Any attempts to manipulate ratings may result in account suspension.

7. Intellectual Property Rights

7.1 Your Content

You retain ownership of content you upload, but grant AI Arena a worldwide, non-exclusive license to:

• Display your content within the Service
• Use your content for platform functionality (voting, competitions)
• Create thumbnails and derivatives for display purposes

7.2 Our Rights

AI Arena and its original content, features, and functionality are owned by AI Arena and are protected by international copyright, trademark, and other intellectual property laws.

8. Content Moderation

8.1 Automated Moderation

All uploaded content is subject to automated scanning for prohibited material.

8.2 User Reporting

Users can report inappropriate content, which will be reviewed by our moderation team.

8.3 Content Removal

We reserve the right to remove any content that violates these terms, with or without notice.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

10. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated systems to access the Service
• Create multiple accounts to circumvent restrictions
• Engage in any form of cheating or manipulation

11. Account Termination

11.1 Termination by You

You may delete your account at any time through the app settings or by contacting us at contact@ai-arena.cz.

11.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms of Service
• Uploading prohibited content
• Engaging in harmful conduct
• Suspected fraudulent activity

12. Disclaimers and Limitation of Liability

12.1 Service Availability

AI Arena is provided "as is" and "as available." We do not guarantee uninterrupted access to the Service.

12.2 Content Disclaimer

We are not responsible for user-generated content and do not endorse any content uploaded by users.

12.3 Limitation of Liability

To the fullest extent permitted by law, AI Arena shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

13. Indemnification

You agree to defend, indemnify, and hold harmless AI Arena from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these terms
• Content you upload to the Service
• Your violation of any third-party rights

14. Changes to Terms

We reserve the right to modify these terms at any time. When we do, we will:

• Post the updated terms on this page
• Update the "Last updated" date
• Notify users of material changes via the app

Your continued use of the Service after changes constitutes acceptance of the new terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and AI Arena regarding the use of the Service.
